Academic License

By accessing the Mild Behavioral Impairment Checklist materials (the “MBI-C”), you agree to be bound by these terms. 

  1. Access: The MBI-C is for the use of users who have agreed to be bound by these terms. As a user, you are granted a non-exclusive license to use the MBI-C for non-commercial research purposes (the “Permitted Purposes”) which means: 
  2. Use by students and academic researchers in non-industry sponsored research; 
  3. Use by clinicians for patient care;  
  4. Use by caregivers in patient care.  


The scope of the Permitted Purposes is an indication of uses which are allowed, but the list of such purposes does not constitute an endorsement, guarantee, representation or warranty by the copyright owners as to the suitability of the MBI-C for such purposes or uses.  You must assess the suitability of the MBI-C for your own purposes and accept the risk of doing so. 

  1. Restrictions: You may not do any of the following without the prior written permission of the copyright owners. You may not: 
  2. use the MBI-C for any purpose other the Permitted Purposes; 
  3. distribute, sell, lease, transfer, assign, trade, rent, publish, republished or license the MBI-C to others; 
  4. edit, modify, translate, or create derivative works of the MBI-C; 
  5. copy or distribute the MBI-C outside the scope of the Permitted Purposes.  
  6. Commercial Use:  A license fee will apply to the use of the MBI-C for any commercial purposes, including use of the MBI-C:  
  7. in clinical trial by a pharmaceutical company;  
  8. in industry sponsored research studies. 


If you wish to use the MBI-C for any purpose other than the Permitted Purposes, including any commercial use, you must first contact a representative of the copyright owner (at ipm@innovatecalgary.com) to determine the applicable license fee, and any additional terms of use.  

  1. Intellectual Property Rights: The MBI-C is protected by copyright. You agree that the MBI-C and any related intellectual property rights are owned by Johns Hopkins University, UTI Limited Partnership and Mayo Foundation for Medical Education and Research, and you will not contest or challenge such ownership.  
  2. Notation of Ownership:  You may not remove any copyright notation on the MBI-C. All MBI-C case report forms or any other permitted republication must carry the copyright notification (Copyright @ Johns Hopkins University, UTI Limited Partnership & Mayo Foundation for Medical Education and Research, 2017. All rights reserved; permission for commercial use required; MBItest.org).   
  3. Use of Names:  
  4. Except as specifically permitted in these terms of access, you shall not use any names or trademarks of Johns Hopkins University in any news release, advertising, publicity, endorsement, promotion, or commercial communication unless Johns Hopkins University has provided prior written consent for the particular use contemplated. The terms of this Subsection survive the termination, expiration, non-renewal, or rescission of these terms of access. 
  5. Except as specifically permitted in these terms of access, you shall not use any names or trademarks of UTI Limited Partnership or the University of Calgary in any news release, advertising, publicity, endorsement, promotion, or commercial communication unless UTI Limited Partnership has provided prior written consent for the particular use contemplated. The terms of this Subsection survive the termination, expiration, non-renewal, or rescission of these terms of access. 
  6. Except as specifically permitted in these terms of access, you shall not use any names or trademarks of Mayo Clinic or Mayo Foundation of Medical Education and Research (collectively “Mayo”) in any news release, advertising, publicity, endorsement, promotion, or commercial communication unless Mayo has provided prior written consent for the particular use contemplated. The terms of this Subsection survive the termination, expiration, non-renewal, or rescission of these terms of access. 
  7. Disclaimer: The MBI-C was developed for research and the checklist not been validated for clinical diagnosis and assessment.  Validation studies are ongoing with respect to scoring and prognostication. The MBI-C is provided “as is” without representations of any kind, and we expressly disclaim any warranty or condition, express or implied, statutory or otherwise, including, without limitation, any warranty as to correctness, accuracy, reliability, or otherwise, or that the MBI-C: (a) is fit for a particular purpose; or (b) does not and will not infringe any copyright, patent, trademark, trade secret or other intellectual property or other proprietary right of any third party.  
  8. Acceptance of Risk: Although we strive to make this service helpful, reliable and current, you understand that your access to and use of the MBI-C is your own decision, and at your own initiative and risk. We do not provide any guarantee of results or success, and we disclaim any warranties or guarantees whatsoever, whether express or implied. We are not liable to you for your use of the MBI-C.  
  9. Limitation of Liability. IN THE EVENT OF AN ALLEGED LOSS OR CLAIM BY YOU, YOU RELEASE AND WAIVE ANY CLAIMS AGAINST THE COPYRIGHT OWNERS AND PROVIDERS OF THIS SITE. IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES, LIABILITIES, COSTS, CLAIMS OR EXPENSES, WHATSOEVER, INCLUDING DIRECT, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH DAMAGE TO PERSON OR PROPERTY, THE USE OF THE MBI-C, OR THE PERFORMANCE OF THIS SITE, OR ANYTHING DOWNLOADED, ACCESSED, AVAILABLE, OR REFERRED TO ON THIS SITE, OR ANY OTHER SITE YOU MAY ACCESS THROUGH THIS SITE, WHETHER ARISING UNDER BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, YOU AGREE THAT OUR AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT OF THE FEE, IF ANY, PAID BY YOU FOR THE ITEM GIVING RISE TO THE LIABILITY, OR THE AMOUNT OF TEN DOLLARS ($10), WHICHEVER IS LESSER. 
  10. Termination or Suspension: We reserve the right to terminate, suspend or discontinue the MBI-C at any time. We reserve the right to change or remove any content on this site. We may, from time to time, need to interrupt the availability of this site, without prior notice, for routine maintenance or other reasons.  
  11. Governing Law. The law of the Province of Alberta applies to these terms, and the courts of the Province of Alberta will be the exclusive forum for the resolution of any disputes under these terms. 
  12. Miscellaneous Terms. The parties have required that these terms be prepared in English. These terms may be assented to by electronic acceptance. Collaborations on MBI research and validation are welcome -- please contact us for details. The copyright owners can be contacted at ipm@innovatecalgary.com.
